Terms of Service

These Terms of Service ("Terms") govern your use of ESTAFast ("we", "us", "our", the "Service"). By using the Service, you agree to be bound by these Terms. Please read them carefully before submitting an application or making a payment.

1. Who We Are

ESTAFast is a private, independent expediting and concierge service that assists travelers in preparing and submitting Electronic System for Travel Authorization (ESTA) applications to U.S. Customs and Border Protection (CBP). We are not a government agency and are not affiliated with, endorsed by, or acting on behalf of the United States government, CBP, the Department of Homeland Security, or any other governmental body.

You are not required to use our Service. You may submit the ESTA application yourself, directly and without any service fee, at the official U.S. government website, esta.cbp.dhs.gov, for the government fee only (currently $21.00 USD).

2. What the Service Includes

In exchange for the Service Fee described in Section 3, we review the information you submit for completeness and common formatting errors, complete and submit the ESTA application to CBP's official system on your behalf using the data you provide, monitor the status of your application, and forward CBP's determination (approval, denial, or request for further action) to the email address you provide.

You may optionally purchase Premium Visa Protection, described in Section 3.3.

3. Fees

3.1 Government Fee. CBP charges a mandatory $21.00 USD ESTA fee for every application, whether submitted directly to CBP or through a third party such as ESTAFast. We collect this fee on your behalf and remit it as part of submitting your application. This fee is set solely by the U.S. government and is outside our control.

3.2 Service Fee. We charge a $39.00 USD service fee for the review, submission, and support services described in Section 2. This fee is retained by ESTAFast regardless of the outcome of your ESTA application, except as expressly set out in our Refund Policy.

3.3 Premium Visa Protection (optional, $12.00 USD). If purchased, and CBP denies your ESTA application, we will refund the Service Fee and the Government Fee paid through us for that application, subject to our Refund Policy. Premium Visa Protection does not influence CBP's decision and does not increase the likelihood of approval.

3.4 Total. Without Premium Visa Protection, the total charge is $60.00 USD ($21.00 government fee + $39.00 service fee). With Premium Visa Protection, the total charge is $72.00 USD.

4. No Guarantee of Approval

ESTA approval is determined exclusively by CBP, based on criteria and databases we do not control and to which we have no access beyond the outcome CBP chooses to disclose. We do not, and cannot, guarantee that any application will be approved, processed within a particular timeframe, or free of requests for additional information or an in-person interview.

Providing false or misleading information may result in permanent ineligibility for ESTA and other U.S. travel or immigration benefits, and may constitute a criminal offense under U.S. law. You are solely responsible for the accuracy of the information you submit.

5. Eligibility

You represent that you are at least 18 years old, or are submitting the application as the parent, legal guardian, or authorized representative of the traveler; that all information you provide is true, accurate, and complete to the best of your knowledge; and that you hold a valid, unexpired passport from an ESTA-eligible Visa Waiver Program country. If you are ineligible under the Visa Waiver Program, a traditional non-immigrant visa — not ESTA — may be required, and our Service cannot obtain one on your behalf.

6. Refunds

Refunds are governed by our Refund Policy, which forms part of these Terms.

7. Limitation of Liability

To the maximum extent permitted by applicable law, ESTAFast and its officers, employees, and contractors are not liable for: any decision made by CBP or any other governmental authority, including denial of travel authorization; indirect, incidental, consequential, special, or punitive damages, including lost travel costs, missed flights, accommodation, or connecting travel arrangements, arising from or related to the Service; or delays caused by CBP systems, third-party payment processors, or events outside our reasonable control.

Our aggregate liability for any claim arising out of or relating to these Terms or the Service shall not exceed the total fees you paid to ESTAFast for the application giving rise to the claim. Nothing in these Terms limits liability that cannot be excluded or limited under applicable law, including liability for fraud or gross negligence.

8. No Warranty

The Service is provided "as is" and "as available." To the extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Data Processing

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data, including the passport and travel information required to complete the ESTA application.

10. Termination and Refusal of Service

We may refuse, suspend, or terminate the Service to any user, including where we reasonably suspect fraud, misuse, provision of false information, or a violation of these Terms. Where your application has not yet been submitted to CBP, applicable fees will be refunded in accordance with our Refund Policy.

11. Governing Law and Your Statutory Rights

These Terms do not limit any non-waivable statutory rights you have as a consumer under the mandatory law of your country of residence, including EU/EEA member states. Nothing in these Terms restricts your right to bring a claim before the courts of, or under the consumer protection law of, your country of residence where such right cannot be excluded by agreement.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
